Welcome to nativetelecom.org (“Site”) which is operated by Native American Public Telecommunications, Inc. (“NAPT”). The Site and any services provided by NAPT on or in connection with the Site (the “Services”) are provided to you (“You”) subject to the following terms and conditions (the “Terms of Service”). By using or subscribing to the Site or the Services, You agree to be bound by these Terms of Service. If You do not agree to the Terms of Service, do not use the Site or Services.
Disclaimer: NAPT's websites and e-newsletters exist to provide information and services to the Native media community and to the public broadcasting industry at large, in keeping with NAPT’s mission and its status as a 501 (c) (3) nonprofit, tax-exempt organization. In the preparation of the information and postings contained in these pages, NAPT has endeavored to make that information as accurate and current as possible. However, inadvertent errors can occur. Therefore, the information on these pages is provided "as is," without any guarantee or warranty of any kind, expressed or implied.

Use of the Site: Effective upon NAPT’s acceptance of your request to become a registered user of the Site if such option is made available by NAPT, and provided that You continue to comply with these Terms of Service, NAPT grants to You a personal, non-assignable, license to log into and access the Site and to place content on the Site (“Your Content”). Some of the services offered by NAPT are free of charge, while others may cost money or have other requirements. Any such fees or requirements will be clearly explained and separately agreed to when You subscribe to such service.
Intellectual Property Policy and Terms of Use: This site contains intellectual property owned by NAPT and others. No material from this web site or any web site owned, operated, licensed or controlled by NAPT (including the AIROS, Indian Net and Vision Maker Video web sites) may be copied, reproduced, republished, uploaded, posted, entered in a database, performed, transmitted, or distributed in any way, without the prior written permission of NAPT, except that you may download one copy of the materials on any single computer for your personal, non-commercial home use only, provided you keep intact all copyright and other proprietary notices. Modification of the materials or use of the materials for any other purpose is a violation of NAPT's copyright and other proprietary rights. Note that any product, process or technology described in the document or trademarks and service marks used in this document may be the subject of other Intellectual Property rights reserved by NAPT, and are not licensed hereunder. Products and materials described and used here may be protected by one or more U.S. patents, foreign patents, or pending applications. If you download software from any of NAPT's web sites, the software, including any files, images incorporated in or generated by the software, and data accompanying the software (collectively, the "Software") are licensed to you by NAPT. NAPT does not transfer title to the Software to you. You own the medium on which the Software is recorded, but NAPT retains full and complete title to the Software and all intellectual property rights therein. You may not redistribute, sell, decompile, reverse engineer, disassemble or otherwise reduce the Software to a human-perceivable form. Software from this site is further subject to the United States export controls. No software from this site may be downloaded or otherwise exported or re-exported into (or to a national or resided of) any country to which the US has restricted exports. By downloading or using the Software, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country. This agreement is effective until terminated by either party. Upon termination you must destroy all materials obtained from any and all NAPT site(s) and all related documentation and all copies and installations thereof, whether made under the terms of this agreement or otherwise.
Your Content: You shall not upload to, or distribute or otherwise publish through the web site any material which is unlawful, libelous, defamatory, obscene, pornographic, vulgar, abusive or otherwise violates any law. You are responsible for ensuring that you have the right to provide Your Content to NAPT for hosting, transmission and publication in connection with the Site and the Services and, notwithstanding any disclaimers or limitations otherwise applicable in respect of Your Content, You agree to hold harmless and indemnify NAPT for any liability arising from Your Content. By submitting Your Content to NAPT, You automatically grant, and Your represent and warrant that You have the right to grant, to NAPT and its licensees an irrevocable, perpetual, non-exclusive, royalty-free, transferable, sublicensable and worldwide license to reproduce, copy, publicly perform, publicly display, publish, reformat, translate, excerpt (in whole or in part), distribute, prepare derivative works (including collections) of, incorporate into other works and otherwise use and exploit Your Content in connection with the Site and NAPT’s business in any media formats and through media channels. You also grant each user of the Site a non-exclusive license to access Your Content through the Site, and to use, reproduce, distribute, display and perform Your Content as permitted through the functionality of the Site and under these Terms of Service. You may remove Your Content from the Site at any time. If You choose to remove Your Content, the above licenses granted by You in Your Content will automatically expire within a commercially reasonable time after You remove or delete Your Content from the Services: however, You acknowledge that NAPT may retain, but not display, distribute or perform, archived copies of Your Content that have been removed or deleted. You retain full ownership of Your Content and any intellectual property rights or other proprietary rights associated with Your Content unless stated for the specific Services.
Termination of Access: If You use the Site in any manner that is prohibited by these Terms of Service, NAPT may without notice terminate or suspend Your use of or access to the Site or the Services.
Prohibited Use of the Site: The Site is provided to You for your personal use. You may not use the Site to engage in any unlawful activity or to infringe the rights of NAPT, its affiliates, members, funders, sponsors or customers. In addition to other requirements contained in these Terms of Service, You further agree that You will not and You will not allow Your employees or agents to (i) interfere with the operation of the Site or the Services, in any way or interfere with anyone’s use or enjoyment of the Site or the Services, or use the Site or the Services to gain unauthorized access to other computer systems; (ii) send chain letters, junk mail, or spam or use any distribution lists or to distribute or publish advertisements; (iii) impersonate any person or entity on or through the Site; (iv) post any content that You do not own or do not have the right to post; (vii) copy, reproduce, modify, sell, lease, scrape content from or aggregate, sublicense, market or otherwise change or commercially exploit in any way the Site or the Services or any component thereof other than as may be expressly permitted in writing by NAPT or as permitted pursuant to any fair use or similar provisions of applicable laws; (viii) disclose Your password, if any, or otherwise grant access to the Site to any third party, other than Your authorized agent.
Privacy Policy: NAPT collects, uses and discloses Your personal information in accordance with our Privacy Policy. By providing information to NAPT, You consent to the use of such information in accordance with the Privacy Policy. This Privacy Policy sets out NAPT’s privacy policies and practices with respect to the collection, use and disclosure of personal information in connection with the Site. This Privacy Policy may be updated by NAPT from time to time. In this Privacy Policy, “personal information” means any information about an identifiable individual.
- Collection and Use of Personal Information: NAPT may collect personal information from You when you use or subscribe for Services, and may collect additional personal information in the course of providing such Services. Contact information that You provide to NAPT may be used to contact you in connection with the Site. This Site allows You to publish personal information about yourself and others, including videos and photos. By publishing your personal information, You consent to the publication of such personal information. By publishing personal information about another individual, You represent that You have, where required by applicable privacy laws, obtained the consent of such individuals to publish such information. NAPT may collect demographic and profile data in connection with the Site, and may use customer information for additional purposes that may be identified at or before the time that information is collected.
- Disclosure of Personal Information: NAPT may disclose personal information as follows: (i) to third party service providers and to affiliated entities in order to carry out work on behalf of NAPT; (ii) to law enforcement agencies for the purposes of investigating fraud or other offences; (iii) to legal, financial, insurance and other advisors or in connection with the sale, reorganization or management of all or part of NAPT’s business or operations; and (iv) as consented to by You, including to fulfill any other purposes that are identified when the personal information was collected.
- Cookies and IP Addresses: NAPT uses your IP address to help identify You and your subscription (if any), gather broad demographic information out its users, and administer the Site. The Site is entitled to use cookies.
Opt-Out: When appropriate, users of the Site are given the opportunity to (i) opt-out of receiving communications from NAPT; (ii) remove their personal information from NAPT records; or (iii) elect to no longer receive services from NAPT. If You wish to opt-out of receiving further communications, please contact NAPT at native@unl.edu.
Claims of Infringement: NAPT respects the intellectual property rights of others. If you believe that your work has been copied and is accessible on the Site in a way that constitutes copyright infringement, please contact NAPT at native@unl.edu.
No Warranties and No Liability: THE MATERIAL ON THIS SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NAPT ALSO DOES NOT WARRANT THAT THIS SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE MATERIAL ON THIS SITE COULD INCLUDE TECHNICAL INACCURACIES OR ERRORS. NAPT DISCLAIMS AND EXCLUDES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW ALL WARRANTIES, REPRESENTATIONS AND CONDITIONS REGARDING USE OF THE SITE OR THE SERVICES. NAPT IS NOT RESPONSIBLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH THE USE OR MISUSE OF THE SITE OR THE SERVICES OR IN RELIANCE ON THE INFORMATION AVAILABLE ON THE SITE EVEN IF NAPT HAS BEEN INFORMED OF THE POSSI8BILITY OF SUCH DAMAGES OR SUCH DAMAGES ARE REASONABLY FORESEEABLE.
Indemnity: You hereby agree to hold harmless and indemnify NAPT and its officers, directors, employees, consultants and agents from any and all third party claims, liability, damages or costs they incur arising as a result of Your misuse of the Site, Your violation of these Terms of Service, or Your infringement of any intellectual property or other right of NAPT or any other person or entity, including such activities that are carried out by any individual using Your login or password information, if assigned.
Job Posting Policy: NAPT has a policy of posting jobs only from organizations with which ithas a direct relationship or partnership (examples include Native and/or public media organizations such as NET, NMAI, Minority Consortia members, and Native radio stations). NAPT cannot post all job opening requests unless the organization provides documentation of the relationship between themselves and NAPT. Postings will be added to the NAPT websites but will not be included in NAPT’s e-newsletters. Questions about the positions posted should be directed toward the contact listed in the job opening. NAPT will not forward requests to these individuals.
